End User License Agreement
License terms for the Cursor Space browser extension and related software.
PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE INSTALLING OR USING CURSOR SPACE.
This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Cursor Space ("Licensor", "we", "us", or "our") for the Cursor Space browser extension, website at cursor-space.com, and any related software, content, or services (collectively, the "Software").
By installing, accessing, or using the Software, you agree to be bound by this Agreement. If you do not agree to these terms, do not install or use the Software.
1. License Grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Cursor Space browser extension for your personal, non-commercial use on devices you own or control, in accordance with this Agreement and applicable browser store policies.
This license does not sell the Software to you. Cursor Space and its licensors retain all rights, title, and interest in and to the Software not expressly granted to you.
2. Restrictions
You agree that you will not, and will not permit others to:
- Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the Software, except as permitted by applicable law.
- Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Software or any portion thereof.
- Remove, alter, or obscure any proprietary notices, labels, or marks on the Software.
- Use the Software for any unlawful purpose or in violation of any applicable laws or regulations.
- Use the Software to distribute malware, spam, or harmful code.
- Scrape, crawl, or systematically extract content from cursor-space.com in a manner that exceeds normal personal browsing, except through interfaces we expressly provide.
- Use the Software in any way that could damage, disable, overburden, or impair our servers or networks.
3. Intellectual Property
The Software, including all cursor packs, graphics, images, text, logos, code, and design elements, is owned by Cursor Space or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Cursor packs and content made available through the Service are licensed for personal use through the extension only. You may not redistribute, resell, or commercially exploit cursor assets unless expressly authorized in writing.
4. User-Uploaded Content
If you upload custom cursors or other content through the Software or our constructor tools, you represent that you have the right to use and share that content. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and process your content solely to provide the Service.
You are solely responsible for content you upload. We may remove content that violates this Agreement, applicable law, or third-party rights.
5. Third-Party Services
The Software may integrate with or link to third-party services, including browser stores, analytics providers, and advertising networks. Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
6. Updates and Changes
We may provide updates, patches, or modifications to the Software at any time. Updates may be installed automatically depending on your browser settings. We may also modify or discontinue features of the Software with or without notice.
We may revise this Agreement from time to time. Continued use of the Software after changes are posted constitutes acceptance of the revised Agreement.
7. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Software will be uninterrupted, error-free, secure, or compatible with all websites. Due to browser limitations, custom cursors may not appear on certain pages, including browser store pages, settings, and other restricted browser UI.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CURSOR SPACE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TEN U.S. DOLLARS (USD $10), IF YOU USE THE SOFTWARE FREE OF CHARGE.
9. Termination
This Agreement is effective until terminated. You may terminate it at any time by uninstalling the extension and ceasing use of the Software. We may suspend or terminate your access to the Software if you violate this Agreement or if we discontinue the Service.
Upon termination, your license ends immediately. Sections that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, and governing law.
10. Age Requirement
The Software is intended for users who are at least 13 years of age. If you are under 13, you may not use the Software. If you are between 13 and the age of majority in your jurisdiction, you may use the Software only with the consent of a parent or legal guardian.
11. Governing Law
This Agreement shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of competent courts in the jurisdiction where Cursor Space operates, unless otherwise required by mandatory consumer protection laws in your country.
